März 2011 erklärte der Gerichtshof der Europäischen Union eine Ausnahmeregelung von den EU-Gleichstellungsvorschrif... wonach geschlechtsspezifische Versicherungsprämien und -leistungen in den Mitgliedstaaten weiterhin erlaubt sind, mit Wirkung vom 21. Dezember 2012 für ungültig.
Die ( vom EU-Ministerrat einstimmig angenommene ) Richtlinie 2004 / 113 / EG des Rates zur Verwirklichung des Grundsatzes der Gleichbehandlung von Männern und Frauen beim Zugang zu und bei der Versorgung mit Gütern und Dienstleistungen verbietet jegliche direkte oder indirekte Diskriminierung aufgrund des Geschlechts außerhalb des Arbeitsmarkts.
Vor dem Urteil konnten die Mitgliedstaaten gemäß Artikel 5 Absatz 2 der Richtlinie bei Versicherungsverträgen von der Gleichstellungsregel abweichen.
