Für während der vierjährigen Übergangszeit vom 19. Juli 2001 bis zum 18. Juli 2005 begründete Verbindlichkeiten gilt die Gewährträgerhaftung ( ab dem 19. Juli 2005 aufgrund des Grandfathering ) unter der Bedingung, dass deren Laufzeit nicht über den 31. Dezember 2015 hinausgeht.
Die Anstaltslast gilt in diesem Fall bis zum 18. Juli 2005.
Ab dem 19. Juli 2001 eingegangene Verbindlichkeiten, deren Laufzeit nicht über den 18. Juli 2005 hinausgeht, fallen vollständig unter Anstaltslast und Gewährträgerhaftung.
