Das Arbeitsverhältnis zwischen dem Arbeitnehmer und dem Arbeitgeber wird in der Regel mit einem Arbeitsvertrag begründet.
Die Erfordernisse des Vertrags richten sich dabei nach dem Gesetz Nr. 262/2006 Slg., Arbeitsgesetzbuch.
Die Problematik des Arbeitsvertrags wird im Kapitel II in diesem Gesetz (§ 33 – 39) gelöst.
