Wer wissentlich über seinen Rechner Viren oder Spam verbreitet, macht sich möglicherweise strafbar nach §§ 303 a, b StGB (Datenveränderung, Computersabotage) und schadensersatzpflichtig nach § 823 (1) BGB.
