Bei diesem Gericht ist ein Amt eingerichtet, dem es zukommt, über die Tatsache des Nichtvollzugs der Ehe und über das Vorhandensein eines gerechten Grundes für die Gewährung der Dispens zu urteilen.
Deshalb nimmt es zusammen mit dem Votum des Bischofs und mit den Anmerkungen des Bandverteidigers sämtliche Akten entgegen, prüft sie gemäß einer besonderen Vorgehensweise und legt gegebenenfalls dem Papst die Bittschrift um Gewährung der Dispens vor.
