A ) Verweigert der Gast die Zahlung des bedungenen Entgeltes oder ist er damit im Rückstand, so steht dem KHW das Recht zu, zur Sicherung ihrer Forderung aus der Beherbergung und Verpflegung sowie ihrer Auslagen für den Gast, die eingebrachten Sachen zurückzuhalten ( § 970 c ABGB gesetzliches Zurückbehaltungsrecht ).
B ) Das KHW hat zur Sicherstellung des vereinbarten Entgeltes das Pfandrecht an den vom Gast eingebrachten Gegenständen ( § 1101 ABGB gesetzliches Pfandrecht des Beherbergers ) .

B)In order to secure payment of the amount agreed, the KHW has the right of retention on objects brought into the accommodation by the guest (§1101 ABGB Right of Lien of the Accommodation Provider).
