Schlägt die Nacherfüllung fehl, kann der Besteller nach seiner Wahl Herabsetzung der Vergütung ( Minderung ) oder Rückgängigmachung des Vertrages ( Rücktritt ) verlangen.
Bei einer nur geringfügigen Vertragswidrigkeit, insbesondere bei nur geringfügigen Mängeln, steht dem Besteller jedoch kein Rücktrittsrecht zu.
