Das Gericht folgte ebenfalls der Argumentation des Obersten Gerichtshofs in Hamdi und stellte fest, dass der Standpunkt der Regierung, wonach die Gefangenen solange inhaftiert werden könnten wie der „ Krieg gegen den Terrorismus “ anhält, einer lebenslangen Freiheitsstrafe gleichkommen könne und die Gefangenen somit ein hinreichendes Interesse an einer gerichtlichen Überprüfung ihrer Gefangenschaft hätten, dass den Gefangenen der Grund ihrer Gefangenschaft mitgeteilt werden müsse und dass ihnen eine gerechte Gelegenheit gegeben werden müsse, die Beweise der Regierung vor einem neutralen Entscheidungsträger zu widerlegen.
Das Gericht befand ebenfalls, dass das CSRT ( Combatant Status Review Tribunal – Tribunal zur Überprüfung des Kombattantenstatus ) den Gefangenen eine solche Gelegenheit nicht gewährte, weil:
1. den Gefangenen kein Rechtsbeistand zuteil wurde;

The Court also found that the CSRT ( Combatant Status Review Tribunal ) did not grant the detainees such a fair opportunity because:
