Auf die Berufung des Beklagten zu 1. ( Arf-Society ) wird dieses Urteil teilweise geändert und insgesamt wie folgt neu gefasst :
Die Klage wird abgewiesen .
Auf die Widerklage des Beklagten zu 1. wird die Gemeinschaftsmarke der Klägerin 001933944 "ZAPPA" für ab dem 01. August 2007 verfallen erklärt.

www.zappanale.deNach Rücktritt vom Vertrag folgten Landgericht und schließlich auch Oberlandesgericht unserer Auffassung, wonach auch der nicht mit zumutbaren Mitteln widerlegbare Verdacht eines Mangels als Mangel anzusehen ist.
Da auch ein Sachverständigengutachten keine Klarheit über die mögliche Mangelhaftigkeit bringen konnte , wurden folgerichtig die Klage abgewiesen und der Widerklage stattgegeben .
