( 5 ) Ist das zurückzugebende Kulturgut dem Rückgabeschuldner geschenkt, vererbt oder vermacht worden, so fallen ihm die Sorgfaltsverpflichtungen des Schenkers oder Erblassers zur Last.
§ 2 Verbringungsverbot und Beschlagnahme ( 1 ) Jede Verbringung von Kulturgut im Widerspruch zu Abschnitt I Nr. 2 des Protokolls aus einem besetzten Gebiet eines Vertragsstaats während eines bewaffneten Konflikts in das Bundesgebiet ist verboten.
Dies gilt nicht für Kulturgut, das im Sinne von Abschnitt II Nr. 5 des Protokolls zum Schutz vor den Gefahren eines bewaffneten Konflikts im Bundesgebiet deponiert werden soll.

Section 2 Prohibition of removal and seizure( 1 ) Any removal of cultural property in contravention of Chapter I, number 2, of the Protocol from an occupied territory of a State Party to the territory of the Federal Republic of Germany during an armed conflict shall be prohibited.
This shall not apply to cultural property which, within the meaning of Chapter II, number 5, of the Protocol, is to be deposited in the territory of the Federal Republic of Germany for the purpose of protecting such property against the dangers of an armed conflict.
