4. Holdingprivileg
Die Ausschüttung von Dividenden durch eine ausländische Tochtergesellschaft an ihre österreichische Muttergesellschaft wird unter bestimmten Voraussetzungen ( 10 % Beteiligung , 1 Jahr Behaltefrist ) in Österreich steuerfrei gestellt ( „ Internationales Schachtelprivileg “ des österreichischen Körperschaftsteuerrechts ) .
Solche Beteiligungserträge sind zwar in Österreich steuerfrei, es kann aber auf Grund eines bestehenden DBA oder des Fehlens eines solchen vom Sitzstaat der Tochter eventuell eine 5- bis 25%ige Quellensteuer einbehalten werden.

Dividend payouts by a foreign subsidiary to an Austrian parent company may be tax exempt in Austria if certain conditions are met (10% share, 1 year holding period), according to the nesting privilege (“Schachtelprivileg“) of the Austrian Corporate Tax Law.
While these payouts may be tax exempt in Austria, they may be subject to a capital gains tax between 5% and 25% due to an existing DTA with the country where the subsidiary is located, or, due to the lack thereof.
