gr2014.euWas bedeutet das Protokoll für Polen und Großbritannien konkret ( und in Zukunft auch für die Tschechischen Republik ) ?
Dessen Ziel ist nicht, die Anwendung der Urkunde der EU-Grundrechte auf dem Gebiet dieser Staaten auszuschließen, sondern nur die Auslegung derjenigen Bestimmungen der Urkunde zu präzisieren, die nicht eindeutig sind und Gegenstand einer extensiven Interpretation durch das EU-Gerichtshof sein könnten.
Die Urkunde der EU-Grundrechte wird daher in diesen Staaten umgesetzt, jedoch bei deren Geltendmachung ist es erforderlich, gerade die Bestimmungen des Protokolls zu berücksichtigen.

Its goal is not to exclude the application of the EU Charter of Fundamental Rights in the territories of the said states, but to detail the interpretation of the provisions of the Charter which are not explicit and could become the subject-matter of extensive interpretation by the EU Court of Justice.
Thus the EU Charter of Fundamental Rights is applied in the states, but the provisions of the Protocol must be taken into account within its application.
