Der Begriff „Gericht“ bezeichnet jedes Justizorgan oder jede sonstige zuständige Stelle eines Mitgliedstaats, die nach einzelstaatlichem Recht befugt ist, ein Insolvenzverfahren zu eröffnen.
Für die Eröffnung des Hauptinsolvenzverfahrens sind die Gerichte des Mitgliedstaats zuständig, in dem der Schuldner/die Schuldnerin den Mittelpunkt seiner/ihrer hauptsächlichen Interessen hat.
