Der Kommission liegen Hinweise dafür vor, dass die 16 Banken, die auf dem CDS‑Markt als Händler auftreten, den Großteil aller wichtigen Tagesdaten zu Preisen, Indizes etc. ausschließlich an Markit, den Marktführer für CDS‑Finanzinformationen, weitergeben.
Grund hierfür könnten kollusive Absprachen zwischen den Banken oder der Missbrauch einer etwaigen kollektiven marktbeherrschenden Stellung sein, die bewirken, dass andere Informationsdienste keinen Zugang zu den wertvollen Ursprungsdaten haben.
Ein solches Verhalten würde im Falle des Nachweises gegen die Kartellvorschriften der EU verstoßen (Artikel 101 und 102 des Vertrags über die Arbeitsweise der Europäischen Union – AEUV).
