§ 21 Ausfuhrgenehmigung
(1) Eine Ausfuhrgenehmigung kann nur der Ausführer beantragen.
(2) Dem Antrag auf Genehmigung der Ausfuhr von Gütern, die in Teil I der Ausfuhrliste genannt sind, sind Dokumente zum Nachweis des Endempfängers, des Endverbleibs und des Verwendungszwecks beizufügen.

Der Ausführer übermittelt diese Angaben der zuständigen Zollstelle elektronisch mit der Ausfuhranmeldung.
(2) Das Zentrum für Informationsverarbeitung und Informationstechnik (ZIVIT) leitet die Daten im Auftrag der zuständigen Zollstelle zum Zweck der Marktbeobachtung an das Bundesamt für Wirtschaft und Ausfuhrkontrolle (BAFA) weiter.

The exporter shall transmit these data to the competent customs office by electronic means together with the export declaration.
(2) The Centre for Data Processing and Information Technology (ZIVIT) shall forward the data on behalf of the competent customs office for the purpose of market observation to the Federal Office of Economics and Export Control (BAFA).
www.gesetze-im-internet.de( 1 ) Erfolgt die Ausfuhrabfertigung aufgrund einer elektronischen Ausfuhranmeldung nach § 12 Absatz 3 Satz 1, ist die Vorlage der Ausfuhrgenehmigung in Papierform bei der Ausfuhrabfertigung grundsätzlich nicht erforderlich.
Der Ausführer hat jedoch sicherzustellen, dass die Ausfuhrgenehmigung im Zeitpunkt der Beantragung der Ausfuhrabfertigung bei ihm oder seinem Vertreter vorhanden ist.
Im Fall des § 12 Absatz 3 Satz 3 hat der Anmelder der zuständigen Zollstelle die Ausfuhrgenehmigung mit der schriftlichen Ausfuhranmeldung zu übermitteln.
