We are also liable according to statutory regulations provided that the delay in delivery for which we are responsible is based on the culpable infringement of a significant contract obligation ; in this case however, the liability for damages is limited to the foreseeable, typically arising damage.
In other respects we are liable in the event of a delay in delivery for every completed week of delay within the framework of a fixed lump sum compensation for delay amounting to 3 % of the delivery value , however not exceeding 15 % of the delivery value .
