Auf einzelstaatlicher und Bundesebene wurde eine Reihe von Gesetzen erlassen, um festzulegen, wie Quilombo-Land identifiziert wird und wie die Vergabe der Landrechte an die verbleibenden Gemeinden erfolgen soll.
Der Präsidentenerlass Nummer 4887 vom 20. November 2003 regelt das Identifizierungsverfahren, die Demarkierung und den Landanspruch von Quilombo-Gemeinschaften.
Zusätzlich zu brasilianischen Rechtsvorschriften ergeben sich für Brasilien auch Verpflichtungen aus dem Übereinkommen Nr. 169 der Internationalen Arbeitsorganisation, der Amerikanischen Menschenrechtskonvention und dem Internationalen Übereinkommen zur Beseitigung jeder Form von Rassendiskriminierung.

In addition to the national legislation, Brazil is a party to the International Labour Organization’s Convention 169, the American Convention on Human Rights and the International Convention on the Elimination of All Forms of Racial Discrimination, which reaffirm the rights of Afro-descendant groups to cultural and land rights as well as the principles of non-discrimination and equality before the law.
